Eberechy's blog: Tribunal Declares Adeleke Winner Of Osun Governorship Election

The Osun State Tribunal sitting in Abuja has declared Ademola Adeleke, governorship candidate of the People's Democratic Party PDP winner of the election held in the State in September 2018.

The judgement delivered was led by Justice Peter Obiora on March 22, 2018.

Adeleke and the PDP, had filed a petition asking the tribunal to declare that he polled the highest lawful votes, and should be declared the winner of the election held on September 23, 2018. In Osun State.

While Oyetola, APC and INEC had filed their notice of objection stressing that the petition was incompetent and that the court lacked jurisdiction.

Reading the ruling, Justice Peter Obiora held that the returning officer of INEC has no power to cancel the election in seven polling Units on September 23, 2018. Which led to the rerun election on September 27, 2018.

The tribunal held that INEC failed to explain nor justify the alterations and as well failed to call any witness to justify the alteration.

The tribunal held that the attempt to explain the alterations on the basis of mere correction of errors is not acceptable and the fact that the said errors were consistently made was deliberate action taken.
